But you’d need to put some hefty fines and/or prison sentences on disregarding the prohibition.

The cookie popups that default to allow for legitimate interest usually have an "object" option, which they claim is enough to satisfy the second part of the sentence, where their interests can be overridden by the interests of the subject. The wording is from Article 6(1)(f) of the GDPR:

"1. Processing shall be lawful only if and to the extent that at least one of the following applies:

(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject [...]"
