Do you need any more proof we live in an where rich corporations pollute as they please? Imagine if you had a court fine and said you weren’t able to pay…you’d be locked up so fast it would make your head spin.

Instead, Flanagan gave the company 90 days to submit its environmental compliance plan and retain an independent environmental consultant, according to the US Attorney's Office for the federal Eastern District of North Carolina.

If the company fails to do so, it will face a $100,000 fine. The company was also sentenced to five years probation, allowing the court to supervise the implementation of the plan. Other conditions in-"

After dumping chemicals into the Cape Fear River for years, American Distillation Inc. avoided a $500,000 fine, and its owner secured a delay in reporting to prison.

American Distillation pleaded guilty in December 2025 to knowingly discharging pollutants into the Cape Fear River over four years. Under its plea agreement, the company faced a fine of up to $500,000 and agreed to establish and enforce an environmental compliance plan.

The company intended to meet those obligations when it signed the agreement, its attorney wrote in August. But its 'current financial circumstances are such that the company does have the funds to pay a fine and may not be able to afford to implement the ECP,' the filing states.
