The ICC needs to get creative to get these people into their custody: E.g. if you do an aggressive war, you cannot later claim someone else did an aggressive war against you for the next 3 decades. It's ugly, but it seems more effective than just signing a treaty that no pragmatic nation would be motivated to keep. (they might already do stuff like this for all I know. i do not know much, but what I do know is that Trump, Bibi and their fans will burn in hell.)
